Warranty and Returns
Every product you buy from HammerHead Spearguns comes with a 30 day limited warranty. The warranty applies to products that have been confirmed as defective by HammerHead Spearguns, which may be repaired or replaced (at our sole discretion).
Unless specified otherwise, HammerHead Spearguns warrants to the Customer that HammerHead Spearguns supplied Products, will be free from defects in materials and workmanship affecting normal use ("Standard Warranty"). This Standard Warranty does not cover damage, fault, failure or malfunction due to external causes, including accident, abuse, misuse, usage and/or storage and/or installation not in accordance with Product instructions, failure to perform required preventive maintenance, normal wear and tear, act of God, fire, flood, war, act of violence or any similar occurrence; any attempt by any person other than HammerHead Spearguns personnel or any person authorized by HammerHead Spearguns, to adjust, repair or support the Products and problems caused by use of parts and components not supplied by HammerHead Spearguns. The Standard Warranty does not cover any items that are in one or more of the following categories: software; external devices; accessories, standard consumables, or parts added to the Product after the Product is shipped from HammerHead Spearguns; accessories or parts that are not installed in the HammerHead Spearguns workshop. During the Standard Warranty period, HammerHead Spearguns will repair or replace Products returned to HammerHead Spearguns premises. All shipping and transportation costs are paid by the customer. This includes prepaying the shipping and transportation charges before HammerHead Spearguns will ship the repaired or replaced products to the Customer. If the shipment is not insured the Customer accepts the risk of loss or damage during shipment and transportation.
HammerHead Spearguns does not give any warranty that the Products are fit for any particular purpose and this Standard Warranty is given in place of all warranties, conditions, terms, undertakings and obligations implied by statute, common law, trade usage, course of dealing or otherwise including warranties or conditions of merchantability, fitness for purpose, satisfactory quality and/or compliance with description, all of which are hereby excluded to the fullest extent permitted by law.
The Customer agrees that, in relation to third party products purchased through HammerHead Spearguns, where such Products are covered by a relevant manufacturers warranty, then the Standard Warranty shall not extend to such Products and such manufacturers warranty shall be the sole warranty in respect of such Products. The Customer shall utilize that warranty for the support of such Products and in any event not look to HammerHead Spearguns for such warranty support.
Returns Other Then Warranty
Returns can only be accepted for products that are in their original unopened and undamaged packaging. A Return Authorization (RA) number must be obtained first, before shipping the product back to HammerHead Spearguns, by contacting a HammerHead Spearguns staff member first. The RA number should be clearly displayed and visible on the product returned, otherwise the return will not be accepted. The Customer shall pay all shipping and transportation charges with relation to the return of any product back to HammerHead Spearguns. A restocking fee of 15% will be deducted from any money refunded after a product is returned. When a Customer uses a Credit card to make a purchase, a refund will be via the same Credit Card used to make the purchase, less any fees that are charged to HammerHead Spearguns. Our credit Card Clearing House charges approximately 3% in fees, which are not refundable. All other refunds paid will be made with a check drawn from an American Bank. Any additional charges and fees that your bank or institution may charge you will be born by you the Customer.
